European Commission to Review Polish Government’s Criticism of Grok

On Thursday, the European Commission confirmed that it will examine the Polish government’s criticism of Grok, the artificial intelligence model developed by social media platform X, which disseminated content praising Adolf Hitler.

“We take these potential issues very seriously,” said Thomas Regnier, spokesperson for the Commission’s Directorate-General for Technological Sovereignty.
Regnier noted that the Commission has already launched several investigations into X under the EU’s Digital Services Act (DSA) to assess the platform’s content moderation policies and the transparency of its algorithms. However, he declined to specify whether the ongoing proceedings will result in penalties.
“Under the DSA, X is obliged to assess and mitigate risks arising from all of its services, including Grok. This includes risks to fundamental rights and illegal content,” Regnier said.
“We take this very seriously, but at this stage, I cannot prejudge the potential next steps the Commission may take.”
In December 2023, the Commission opened an investigation into X’s content moderation practices to evaluate what measures the company is taking to remove illegal content. It is currently reviewing documentation submitted by the company’s legal team before moving forward with the case.
Additionally, in July 2024, the Commission concluded that X had violated the Digital Services Act by failing to ensure transparency in its advertising, by denying authorities and researchers access to information on how its algorithms function, and by encouraging users to take actions that go against their own interests. However, no sanctions have yet been imposed.
